01About this policy
Momentify is operated by Murray Initiatives Pty Ltd (ABN 23 698 407 028), a company registered in Western Australia, trading as Momentify ("Momentify", "we", "us", "our"). We operate the website getmomentify.com and the Momentify application.
This policy explains how we handle personal information when you visit our website, take our quiz, reserve a place, hold an account, upload content, or view a gallery someone has shared with you.
Momentify is currently offered to customers in Australia, New Zealand and the United States. We do not market our services in the United Kingdom or the European Union. If you are in the UK or EU and choose to use Momentify, the rights described in section 12 still apply to you.
Two different roles we play
When you are our customer, we decide how your personal information is used. In UK and EU terms, we are the controller.
When our customer uploads footage of other people, our customer decides what happens to it, and our customer is responsible for having obtained consent from the people in it. We only store and process it on their instruction. In UK and EU terms, they are the controller and we are the processor. If you appear in a gallery and want your information removed, contact the creator who made the gallery. You can also contact us and we will pass your request on.
Laws this policy is written to
- Australia: Privacy Act 1988 (Cth) and the Australian Privacy Principles
- New Zealand: Privacy Act 2020 and the Information Privacy Principles
- United Kingdom and European Union: the UK GDPR, the Data Protection Act 2018 and the General Data Protection Regulation, which we apply to anyone in those regions who uses Momentify even though we do not market there
- United States: California Consumer Privacy Act as amended by the CPRA, and state biometric privacy laws including the Illinois Biometric Information Privacy Act
02Information we collect
Information you give us
- Quiz answers: how many weddings you shoot, typical booking length, whether you work with a second shooter, camera settings, how you deliver to couples and the tools you use.
- Contact details: first name and email address.
- Account details: name, business name, email, password, business address, logo and branding you upload, and your plan.
- Messages: anything you include when you contact us.
Content you upload
Video clips, photographs and any audio within them, plus the technical information attached to those files, such as camera model, capture date and time, file size, duration and any location coordinates recorded by your camera. We also hold the gallery structure you create, including scene names, titles and descriptions.
Footage of a wedding or event contains personal information about the people in it, including your clients and their guests. We handle that on your instruction, as set out in section 01.
Biometric information
If face search is used on a gallery, we create numerical representations of faces, sometimes called face templates or faceprints, from sampled frames of the footage. These are biometric information. Section 05 explains this in full.
Payment information
Payments are processed by Stripe on its secure checkout. We never see or store your full card details. Stripe provides us with limited information such as your name, email, billing country, amount paid, payment status, card type and the last four digits.
Information collected automatically
IP address, device and browser type, operating system, approximate location based on IP address, pages viewed, clicks, scrolls and mouse movements, time on page, referring website, cookie and advertising identifiers, campaign tags such as UTM parameters and ad click IDs, and, inside the app, records of uploads, downloads, logins and gallery views.
Gallery viewers
If a creator shares a gallery with you, we collect your email address where the gallery requires one, along with your IP address, device information and a record of what you viewed, favourited or downloaded. This information is shown to the creator who owns the gallery.
03How we collect it
- Directly from you when you take the quiz, reserve a place, open an account, upload content or contact us.
- Automatically through cookies, pixels, tags and similar technologies. In the UK and EU, non-essential tools load only after you agree.
- From third parties such as Stripe, and advertising platforms such as Meta and Google.
- From our customers, when they upload footage containing other people.
04How we use it, and our lawful basis
The lawful basis column applies to people in the UK and EU. Everywhere else we use your information for the purposes described.
We do not sell your personal information, and we do not share it for cross-context behavioural advertising in the meaning of the California Consumer Privacy Act, other than the advertising cookies described in section 06, which you can turn off.
We do not use your footage to train our AI models for use with other customers unless you have given us separate, specific permission.
05Face search and biometric information
What we collect and why
When face search is enabled on a gallery, our system samples frames from the video clips in it and creates a numerical representation of each face it detects. That representation is a face template. It is used for one purpose only: to let people find the clips a particular person appears in, within that gallery.
What we do not do
- We do not sell, lease, trade or profit from face templates.
- We do not use face templates to identify anyone by name, or match faces across different galleries or different customers.
- We do not share face templates with advertisers, data brokers or law enforcement, unless we are legally compelled to.
- We do not use face templates to train our models.
How long we keep them
Face templates are deleted when the gallery is deleted, when the creator turns face search off, when the subscription ends and the retention period in section 09 expires, or within 30 days of a valid deletion request, whichever happens first. We do not keep them for longer than three years in any case.
Consent
If you are a creator, the responsibility for consent is yours. You know who is in your footage, you have the relationship with your client, and you were in the room. We do not. By uploading footage to Momentify and by enabling face search, you confirm that:
- you have the right to upload the footage and to have us process it;
- you have obtained all consents required from your client and from the people who appear in the footage, including for the creation of face templates where face search is enabled;
- those consents meet the requirements of the country and, in the United States, the state where the footage was recorded and where the people in it live;
- you will tell us promptly if any of those people withdraw consent or ask for their information to be removed.
Our job is to keep that footage secure, to use it only as you instruct, to delete it when you tell us to, and to meet our own obligations under the laws listed in section 01. Obtaining consent is not something we can do on your behalf, and we do not verify it.
The full terms of this arrangement, including your warranties and indemnities, are set out in our Terms of Service.
If you are a guest or a client: if you use face search to find yourself in a gallery, you will be asked to agree before any face template is created from your image. You can withdraw that agreement at any time by emailing hello@getmomentify.com or by contacting the creator who owns the gallery. Withdrawing means your face template is deleted. It does not remove the footage itself, which belongs to the creator and their client.
Where face search is not available
We may restrict or disable face search in jurisdictions where we cannot meet the legal requirements. Where local law requires written consent before biometric information is collected, face search will not operate until that consent is recorded.
08International transfers
We are based in Australia. Some of our providers store or process personal information outside your country, including in the United States, the European Union, the United Kingdom and other locations where these providers operate data centres.
Uploaded footage is stored in the Asia Pacific (Oceania) region, which keeps it close to most of our customers. Some of our other providers, such as Stripe, Google, Meta, Microsoft and Airtable, process information in the United States, and our website host Hostinger operates in the European Union.
We take reasonable steps to make sure overseas recipients handle personal information consistently with the Australian Privacy Principles and the New Zealand Information Privacy Principles. Where a transfer out of the UK or European Economic Area is involved, we rely on the UK International Data Transfer Addendum or the European Commission's Standard Contractual Clauses. You can request details from hello@getmomentify.com.
09Storage, security and retention
Uploaded footage is stored with Cloudflare R2 in the Asia Pacific (Oceania) region. We use encrypted connections, encryption of stored files, access controls and logging. No method of storage or transmission is completely secure, but we take reasonable steps to protect your information from misuse, loss and unauthorised access.
If a data breach is likely to cause serious harm, we will notify you and the relevant regulator as required by law.
10Marketing emails
If you give us your email address, we may send you updates about Momentify. Every marketing email has an unsubscribe link, or you can email us. We will still send essential emails about your account, reservation or payments.
11Automated processing
Two parts of Momentify make automated suggestions.
The quiz uses your answers to estimate time saved and suggest a plan. It is a suggestion only and you can choose any plan.
AI culling analyses your footage to suggest which clips to keep, flag or remove, and to group clips into scenes. You review and can override every suggestion. Nothing is deleted without your action.
Neither produces a decision with a legal or similarly significant effect on you. If you are in the UK or EU and disagree with an automated outcome, you can ask for human review by emailing us.
12Your rights and choices
Wherever you live, you can ask us to access your information, correct it, delete it, or stop sending you marketing. Email hello@getmomentify.com. We may need to verify your identity. There is no charge, and we respond within 30 days, or within 20 working days in New Zealand.
United Kingdom and European Union
You also have the right to receive your data in a portable format, to restrict how we use it, to object to processing based on legitimate interests, and to withdraw consent at any time without affecting what we did before you withdrew it. You can complain to your national data protection authority, or in the UK to the Information Commissioner's Office.
We do not currently offer or market Momentify in the United Kingdom or the European Union, and we have not appointed a representative in those regions. If that changes we will appoint one and name them here.
California
You have the right to know what personal information we collect and how we use it, to delete it, to correct it, to opt out of sale or sharing for cross-context behavioural advertising, to limit the use of sensitive personal information, and not to be discriminated against for exercising these rights. We do not sell your personal information. To opt out of advertising cookies, use our cookie settings link. You can nominate an authorised agent to make a request on your behalf.
If you appear in a gallery but are not our customer
The creator who owns the gallery decides what happens to that footage. Contact them first. If you cannot reach them, email hello@getmomentify.com and we will pass your request on and help where we can. We can delete a face template created from your image on request, without needing the creator's agreement.
13Children
Momentify is built for professional content creators. Our website and app are not directed at people under 18 and we do not knowingly collect their personal information as customers.
Footage uploaded by our customers may contain images of children who are guests at an event. We handle that footage on the creator's instruction. Creators are responsible for holding the necessary permissions, including from a parent or guardian where required, and must not enable face search on footage of children unless the law where the event took place allows it and they hold that permission.
14Complaints
If you have a concern about how we have handled your personal information, email hello@getmomentify.com first. We will look into it and respond within 30 days. If you are not satisfied, you can contact:
- Australia: the Office of the Australian Information Commissioner
- New Zealand: the Office of the Privacy Commissioner
- United Kingdom: the Information Commissioner's Office
- European Union: your national data protection authority
15Changes to this policy
We will update this policy as our services change. The latest version is always on this page with the date it was last updated. If we make significant changes, we will let you know by email before they take effect.
